By law, your landlord is required to protect your deposit within 30 days of them receiving it. This is to stop landlords from using the deposit as their own income and to ensure that the deposit is protected when your tenancy is over. If they fail to protect your tenancy deposit, they are liable to a penalty of between 1-3 times the amount of the deposit paid. DO I HAVE A CLAIM?
The law is very clear. If your landlord hasn’t placed your deposit in an approved rent deposit scheme, in accordance with the regulations, you are entitled to make a claim
HOW MUCH COMPENSATION CAN I EXPECT TO RECEIVE?
You can claim compensation up to three times the value of your deposit. If for example you paid a deposit of £1,000, you could be awarded up to a maximum of £3,000 in compensation, plus the return of your initial deposit amount.
WHAT IF I LEFT SEVERAL YEARS AGO?
If you started a tenancy agreement within the last 6 years then you can make a claim, or, if you changed from your fixed term to a periodic tenancy agreement (i.e new 6 month agreement or rolling 1 month agreement) you can claim against each one of those new agreements.
WILL I HAVE TO GO TO COURT?
